Promoter, period and eligibility

  1. Promoter. The promoter is Kraken Concepts Pty Ltd trading as Mistech Cooling (ABN 23 647 853 745) of Cannonvale, QLD (Promoter). Information on how to enter and the prize forms part of these terms. By entering, entrants accept these terms. These terms are available at https://www.mistechcooling.com.au/giveaway.
  2. Promotion period. The Summer Mist Giveaway (Promotion) opens at 9:00am AEST on Sunday 1 November 2026 and closes at 11:59pm AEST on Monday 30 November 2026 (Promotion Period). All times are Australian Eastern Standard Time (Queensland time). Entries received outside the Promotion Period will not be accepted.
  3. Eligibility. Entry is open to Australian residents aged 18 years or over at the time of entry.
  4. Exclusions. Employees, contractors and directors of the Promoter, their immediate families, and anyone associated with running this Promotion are not eligible to enter.
  5. Free to enter. No purchase is necessary. This is a game of chance; skill plays no part in determining the winner.

How to enter

  1. To enter, during the Promotion Period an eligible entrant must, on the Promoter's official giveaway post on Facebook or Instagram:
    • follow the Mistech Cooling page or account on that platform;
    • like the giveaway post; and
    • comment on the giveaway post answering the question "Where would you set up your misting system this summer?"
  2. Entrants are limited to one entry per platform (one on Facebook and one on Instagram), plus one Instagram bonus entry under clause 8, so a maximum of three entries per person. Additional comments will not count as additional entries.
  3. Instagram bonus entry: an entrant who has entered on Instagram receives one bonus entry by sharing the giveaway post to their Instagram Story during the Promotion Period and tagging @mistech_cooling. The account must be public, or the Promoter must otherwise be able to see the Story, for the bonus entry to be recorded. Sharing on Facebook is welcome but does not earn an entry, and tagging friends is not required on either platform.
  4. Entries must be made from a genuine personal account. Entries made using bots, multiple or fake accounts, or automated means are invalid.
  5. Comments must not be offensive, defamatory or unlawful. The Promoter may remove such comments and disqualify the entry.
  6. The Promoter may verify any entrant's eligibility and disqualify any entrant who tampers with the entry process or does not comply with these terms.

Prize

  1. There is one prize: a Mistech Cooling outdoor misting system tailored by the Promoter to suit the winner's outdoor area, valued at up to $2,990 (including GST and delivery) (Prize). The total prize pool is up to $2,990.
  2. The system supplied will be chosen by the Promoter based on the size and layout of the winner's space. Depending on the space, this may be a system up to the value of a MistPro 200, or a smaller system such as an Eco Mist25. The value of the Prize will vary accordingly.
  3. To design the system, the winner must provide photos, measurements and any other information the Promoter reasonably requests.
  4. Delivery to an address within Australia is included. The Promoter will aim to deliver before 25 December 2026, but delivery timing is not guaranteed.
  5. Installation is not included. The winner is responsible for installation and all related costs, including any licensed plumbing or electrical work required.
  6. The Prize is not transferable or exchangeable and cannot be taken as cash. If the Prize becomes unavailable, the Promoter may substitute a prize of similar value, subject to any applicable law.
  7. The prize value is the recommended retail price at the time of publishing these terms. The Promoter accepts no responsibility for any change in value.

Draw and winner

  1. The draw will take place at 12:00pm AEST on Tuesday 1 December 2026 at the Promoter's premises in Cannonvale, QLD, conducted by a representative of the Promoter and witnessed by a second person, and will be screen-recorded. The winner will be the first valid entry drawn at random from all valid entries received on both platforms, using an online random selection tool. Two reserve entries will also be drawn at the same time and recorded in the order drawn.

  2. The winner will be notified by a reply to their comment and by direct message on the platform they entered on within 2 business days of the draw. The winner's first name, initial of their surname and social media handle will be published on the Promoter's Facebook and Instagram pages on or before 4 December 2026.

  3. The winner must reply to the Promoter's message within 7 days of notification and provide their full name, delivery address, phone number and proof of age and residency if requested.
  4. If the winner does not respond within that time, is ineligible, or declines the Prize, the Prize will be offered to the first reserve entry, then the second. If no reserve entry claims the Prize, an unclaimed prize redraw will take place at 12:00pm AEST on Tuesday 8 December 2026 at the same location. Any redraw winner will be notified and published in the same way.
  5. The Promoter's decision on all matters relating to the Promotion is final, and no correspondence will be entered into.

General conditions

  1. Meta release. This Promotion is in no way sponsored, endorsed, administered by or associated with Facebook, Instagram or Meta Platforms, Inc. Entrants release Meta from any liability. Any questions should be directed to the Promoter, not Meta.
  2. Privacy. The Promoter will collect entrants' names, social media handles and comments, and the winner's contact and delivery details, to run the Promotion, deliver the Prize and publish the winner. With consent, the Promoter may also use this information to send entrants information about its products. Entrants can request access to or correction of their information by contacting mail@mistechcooling.com.au. The Promoter's privacy policy is at https://www.mistechcooling.com.au/privacy_policy.
  3. Publicity. With the winner's consent, the Promoter may use the winner's name, state and photos of the installed Prize in its marketing.
  4. Liability. Except for any liability that cannot be excluded by law (including under the Australian Consumer Law), the Promoter is not liable for any loss or damage, including personal injury, arising from entering the Promotion or accepting or using the Prize. Product warranties apply to the Prize as normal.
  5. Technical issues. The Promoter is not responsible for entries that are lost, late, or not received because of platform outages, comment filtering, or technical faults.
  6. Changes. If the Promotion cannot run as planned because of circumstances beyond the Promoter's control, the Promoter may modify, suspend or cancel it, subject to any applicable law or direction from a regulator.
